If it's old school mpeg at 33kbps, you'll certainly hear that. How does it sound?

What software do you use? Try encoding with different software. Try playing the files on another player or some other software.

What is telling you they're mp1 files? What software are you using? Load them into foobar or similar and look at them in there.

If you are certain, that those are indeed MP3 files, you could use foobar2000 and right-click any of those files:
in the context menu, you should find "utilities" > "rebuild MP3 stream"
if they are VBR encoded, you could also try "utilities" > "fix VBR MP3 header"

If your software tells you that the files are "MPEG 1 Audio Layer 3", it is absolutely correct.
It's only audiophile if it's inconvenient.

that much is true ... but still, the 33kbps look like a broken VBR header to me

I actually DL'd from someone else, not sure what they used to encode them. The quality isnt bad on the files, no worrbles  or artifact noises on the track, just show up Mp1 @ 33kbps on Foobar..... Never really looked at them in other software, going to give that a try though.

Thanks.

Take a screen shot of what you're seeing. As previously said, right-click on the file in foobar and check the properties.

I'm very new to Foobar, so far its become my favorite Media Library, possibly the best one that iv'e ever used! I tried Rebuilding the Mp3 Stream, but i could only do some...plus it shows the tracks to be an hour and some minutes long... they are not that long lol

Here's the same song (highlighted) in Explorer's Properties, and what Foobar is showing.

I did try Rebuilding the Mp3 Stream, and it did work for most, but they're still some that didn't get fixed.... so i tried Rebuling the Header, and a error pops up saying that it couldn't do it.

As the error message tells you, foobar2000 determined that those are MPEG 1 Layer 1 files, which should get the extension ".mp1". I'm not sure whether foobar2000 will play those, but ffmpeg, mplayer or VLC might.

On the other hand the files could simply be broken.
It's only audiophile if it's inconvenient.

Well here is the weird thing, some apps won't play them.... I dj, and i use Traktor, and i know that Traktor will not play those songs. But Foobar actually does... But Traktor shows the normal Bitrates, Duration's, and Extensions correctly.

I used a program called Mp3Val, which is suppose to fix broken mp3's, and they seemed to be okay.

They might contain a broken tag in the start of the file (I say broken, because else, foobar would know about it).

If you are confident with using an hex editor (like HxD ), try and open those files and see what happens

You might also try first to download mp3directcut and see if that software is able to detect the mp3 file correctly. With that one, you could cut the first few frames and obtain a correct file.

One thought, convert them from MP3->MP3 (yes I know technically degrading) but just to see what bitrate they end up as?

It does sound like a broken header though or something like that.

I'm with JAZ. A screenshot of the beginning of the file, as seen in a hex editor, would help a lot.

What is a hex editor? Excuse the noobiness.

1) How do you know they are not mp1layer1?

2) You can calculate bitrate - at least approximately - by filesize divided by number of seconds (multiply by 8 to get kilobits rather than kilobytes). Do you get a reasonable answer?

2) What does VLC tell you about the file? VLC often determines content from content rather than from extensions or headers (checking to see if you get fooled).

3) Can you use ffmpeg? ffmpeg -i, what information does that give?

For me, it looks like a damaged ID3 header. It contains some JPEG picture (APIC tag) which may have some bytes looking like sync frames.

Indeed, that graphic might be the culprit. Either because of incorrectly added into the tag, or being too big.

Make a copy of one of the files. Try to remove the images with foobar2000 (select file, right mouse click on it, tagging -> remove all pictures).
Else, try a tag editor ( like http://www.mp3tag.de/en/ ) to remove it.

If none of those things help, a manual edition would seem to be needed, and it's clear that you're not ready to do that.
